1. About Sume

Sume (“we,” “us,” or “our”) operates the website and related services (collectively, the “Services”). Sume is an AI-powered platform that generates motion-controlled influencer video content. By accessing or using the Services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old to access or use any part of the Services. By using the Services, you represent and warrant that you are at least 18 years of age. We reserve the right to terminate access for any user we reasonably believe to be under 18.

3. AI Disclosure — All Characters Are Fictional

All personas, character images, and generated video content on Sume are entirely fictional and created by artificial intelligence. No character on Sume is a real person. Character images are AI-generated and do not depict any real individual. Any resemblance to real persons, living or dead, is purely coincidental.

AI-generated content may be inaccurate, inconsistent, or inappropriate. You should not rely on any content generated by the Services for medical, legal, financial, or other professional advice.

4. Video Generation Services

The Services allow you to generate AI-powered video content using reference images, motion clips, and text prompts. Generated videos are synthetic and do not represent real events or real people. We may impose rate limits on generation features. Generation availability and quality are not guaranteed.

5. Paid Subscriptions

A. Subscription plans

Certain features of the Services, including premium generation capabilities, require a paid subscription. Subscription pricing is displayed before purchase.

B. Payment processing

Payments are processed by Stripe, Inc. By subscribing, you agree to Stripe's terms of service. Your payment information is handled directly by Stripe and is not stored on our servers.

C. Recurring billing

Subscriptions are billed on a recurring basis (monthly or as specified at checkout). You authorize us to charge your payment method on each billing cycle until you cancel.

D. Cancellation & refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods. If you believe you were charged in error, contact us at dev@sumelabs.com within 14 days of the charge.

6. User Conduct

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law
• Attempt to extract, scrape, reverse-engineer, or derive the underlying AI models, prompts, or systems
• Upload content that is illegal, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to bypass rate limits, payment requirements, or access controls
• Use the Services to generate content that exploits, harms, or endangers minors
• Redistribute, resell, or publicly display AI-generated content without our written permission
• Impersonate any person or misrepresent your identity or age
• Use automated scripts, bots, or tools to interact with the Services

We reserve the right to suspend or terminate your access at any time, without notice, for conduct that we determine violates these Terms or is harmful to the Services or other users.

7. Intellectual Property

All content on Sume — including AI-generated videos, character designs, logos, website design, and software — is owned by Sume or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on any Sume content without our prior written consent.

You retain ownership of the inputs you provide. By uploading content, you grant Sume a non-exclusive, worldwide, royalty-free license to use, process, and store your content for the purpose of providing and improving the Services.

8. Content Disclaimer

The Services may generate content that is unexpected, inaccurate, or inconsistent. By using the Services, you acknowledge that you may encounter such content and that you are accessing it voluntarily. Sume is a creative tool. Nothing generated by the Services should be construed as professional advice, a factual representation, or an endorsement of any kind.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUME AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THE SERVICES EXCEED THE AMOUNT YOU PAID TO SUME IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Sume and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association.

13. Changes to These Terms

We may update these Terms at any time by posting the revised version on this page. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.
